General Premium Experiences Terms & Conditions

All Melbourne Stars Premium Experiences are subject to the following terms and conditions. By purchasing a Melbourne Stars Premium Experience, you agree to be bound to these terms and conditions.

This agreement constitutes the entire agreement between Melbourne Stars and you as to its subject matter.

1. Definitions

a) "Melbourne Stars" means Melbourne Stars (ABN 48 152 852 278) of CitiPower Centre, Lakeside Drive St Kilda VIC 3182.

b) “BBL” means the men’s Big Bash League Competition played under the auspices and control of Cricket Australia.

c) “BBL|08” and “WBBL|04” refers to the Big Bash men’s and women’s seasons that are currently expected to commence on or around December 2018 and conclude on or around February 2019.

d) "Cricket Australia" means Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont, VIC 3002.

e) "Cricket Victoria " means Cricket Victoria (ABN 528 004 128 812) of CitiPower Centre, Lakeside Drive St Kilda VIC 3182.

f) "You" or “your” means the individual person who is designated as the purchaser of the Premium Package options.

g) “MCG” means the Melbourne Cricket Ground, located at Brunton Avenue, Jolimont VIC 3002.

h) “MCC” means the Melbourne Cricket Club, located at Gate 2, Melbourne Cricket Ground, Brunton Avenue, Jolimont VIC 3002.

i) “WBBL” means the women’s Big Bash League competition played under the auspices and control of Cricket Australia.

j) Client means the Company or individual listed in the Melbourne Stars Premium Experience online booking form as booking the Package.

k) Package means a Corporate Suite Package or experience booked for a Melbourne Stars match day.

l) Match refers to any Premium Experience hosted on a Melbourne Stars Big Bash League men’s match in BBL08.

m) Experience refers to all of the packages made available.

n) “Junior” refers to any individual aged 17 years and under

o) “"Adult” refers to any individual aged 18 years or older

2. Tickets

2.1 Premium Experiences of the Melbourne Stars is open to individuals and families, including employees of the Melbourne Stars, Cricket Victoria and Cricket Australia.

2.2 Tickets will be issued to the Client on the later of –

(a) 10 Business Days before the Match; or

(b) when full payment for a Package is received.

2.3 Applications for replacement of lost tickets and vouchers may be made in writing to the Melbourne Stars, specifying the ticket number(s) of the lost ticket and Match details, no later than 10 Business Days prior to the Match Day.

2.4 Only official Melbourne Stars Premium Experience Package ticketing will be accepted for entry into a Corporate Suite or an Experience.

2.5 Clients must ensure that their guests display the correct ticketing at all times. No person will be admitted to any Corporate Suite or Dining Facility without the correct ticketing. The Melbourne Stars, MCC and the MCG Caterer reserve the right to refuse to admit or serve a person who is not displaying the correct ticketing.

3. Purchase of Premium Experience

Melbourne Stars has the right to accept or reject any registration for Premium Experiences of Melbourne Stars at its sole and absolute discretion. It is entitled to reject registration even after payment for an experience has been processed and confirmation of experience registration has been provided. In the event rejection occurs after payment is received, Melbourne Stars may refund the relevant experience fee to the applicant.

Cricket Victoria Online Shop: All premium packages purchased via the Cricket Victoria online shop will incur a 1.75% processing fee and a $0.30 fee per transaction.

Ticketek: Any Premium Packages purchased via the Ticketek will incur additional fees as per their terms and conditions set out on their website www.ticketek.com.au.

Any hospitality packages purchased through our third party supplier TixStar https://www.tixstar.com.au/ will also be applicable to their terms and conditions and any fees associated to utilising their online purchase portal.

4. Premium Packages

Melbourne Cricket Ground Premium Packages available for the Melbourne Stars Big Bash 2018-2019 cricket season inclusive. For any queries please direct them to VIP@melbournestars.com.au .

4.1 The Ultimate Experience, Melbourne Cricket Ground (MCG)

The Ultimate Experience is valued at $5500.00 (inc. gst) and includes the following benefits:

4.1.1 Maximum of four (4) guests

4.1.2 VIP entry tickets to access the MCG

4.1.3 Seating on the MCG boundary line

4.1.4 An all-inclusive food and beverage package that is catered for by the MCC caterer. Excludes spirit beverages.

4.1.5 A pre-match pitch walk & coaches address

4.1.6 Dedicated steward taking care of requests on the day

4.1.7 One (1) x MCG VIP Parking spot within the MCG venue. Notification of car park will be provided via an email notification from the Melbourne Stars no later than 10 days prior to the event.

4.1.8 Age restriction for The Ultimate is for children aged 6 plus. All children aged between 6 to 16 must be accompanied by a parent or guardian.

4.2 Stars Lounge, Melbourne Cricket Ground (MCG)

The Stars Lounge adult ticket is valued at $225.00 (inc. gst) and children from 6 – 17 years at $75.00 (inc. gst). Benefits include:

4.2.1 Entry ticket into the MCG

4.2.2 Access to the Stars Lounge, Level 2 Olympic Stand, Olympic Room

4.2.3 An all-inclusive food and beverage package that is catered for by the MCC caterer. Excludes spirit beverages.

4.2.4 Unallocated premium reserved seating for all guests at the front of the venue on level 2.

4.2.5 Air-conditioned function Room (Olympic Room)

4.2.6 Capacity is between 1 – 200 patrons.

4.3 Stars Social, Melbourne Cricket Ground (MCG)

The Stars Social is an 18+ adult package valued at $95.00 (inc. gst) per person. No children or young adults under the age of 18 will be permitted into this offering. Benefits include:

4.3.1 Access to air-conditioned function room

4.3.2 Reserved seating on Level 2; behind the bowler’s arm

4.3.3 Private cash bars exclusive to Stars Social guests for alcoholic & non-alcoholic beverage purchases

4.3.4 Gourmet food available for purchase

4.3.5 Capacity is between 1 – 150 patrons.

4.4 Stars Family Room, Melbourne Cricket Ground (MCG)

The Stars Family Room adult ticket is valued at $75.00 (inc. gst) and includes one (1) free children entry ticket. Additional tickets for children are valued at $20.00 (inc. gst) per child. Benefits include:

4.4.1 Any adult ticket purchased will receive one free ticket for a child aged between 6 and 17 years of age.

4.4.2 All children aged five (5) and under can enter the venue free of charge. Juiors under 6 cannot occupy a seat

4.4.3 Premium seating on Level 2 Ponsford Stand, MCG

4.4.4 Access to the air-conditioned function room (Harrison Room)

4.4.5 Maximum one (1) glass of sparkling wine for each adult ticket holder

4.4.6 Private cash bar and access to food for purchase

4.4.7 Face painter and visits from Stars mascots, Starman & Starlet

4.4.8 Capacity is between 1 – 100 patrons.

4.5 Kids Parties, Melbourne Cricket Ground (MCG)

All requests for hosting a Kids Party must be sent through to VIP@melbournestars.com.au.

The matches Kids Parties are available are limited to the 14 January, 27 January and 10 February 2019.

Benefits of a Kids Party includes:

4.5.1 Access to a private birthday area and premium seating on Level 2, square of the wicket

4.5.2 Kid friendly party food package as outlined by the Melbourne Stars.

4.5.3 Visit from Stars’ mascots, Starman & Starlet

4.5.4 Private cash bar available for parents

4.5.5 Maximum kid’s parties per match is 1-3 (or as Melbourne Stars deem available)

Metricon Stadium Premium Packages available on the 5th January 2019 match only.

4.6 The Ultimate Experience – 5th January 2019, Metricon Stadium, Gold Coast

The Ultimate Experience is valued at $5500.00 (inc. gst) and includes the following benefits:

4.6.1 Maximum of four (4) guests

4.6.2 VIP entry tickets to access the Metricon Stadium on the 5 th January 2019.

4.6.3 Seating on the Metricon Stadium boundary line

4.6.4 An all-inclusive food and beverage package that is catered for by the Metricon Stadium caterer. Excludes spirit beverages.

4.6.5 A pre-match pitch walk & coaches address

4.6.6 Dedicated steward taking care of requests on the day

4.6.7 One (1) x Metricon VIP Parking spot within the venue

4.7 VIP Stars Suites, Metricon Stadium Gold Coast

VIP Stars suites are available in both 12 and 18 seated corporate facilities. All clients will have access to reserving a private box at $1800.00 (inc. gst) for a 12 seater or $2700.00 (inc. gst) for an 18-seater suite. Benefits include:

4.7.1 Private air-conditioned suite

4.7.2 Prime outdoor seating on Level 3

4.7.3 Premium food & beverage package is at client’s additional cost. Please send all hospitality package queries to VIP@melbournestars.com.au to request your food orders.

4.7.4 1 VIP car park per suite & match programs. Notification of car park will be provided via an email notification from the Melbourne Stars no later than 10 days prior to the event.

4.7.5 Dedicated personal steward is at an additional cost per suite.

4.8 The Dugout, Metricon Stadium Gold Coast

The Dugout experience adult ticket is valued at $195.00 (inc. gst) and children aged between 6 – 17 years of age at $50.00 (inc. gst). Benefits include:

4.8.1 Level 1 seating behind the Stars dugout

4.8.2 All-inclusive premium food & beverage served throughout match

4.8.3 Hear from Stars players & coaches pre-match

4.8.4 Exclusive viewing of the Melbourne Stars warm-up room and player’s area

4.9 The Club, Metricon Stadium Gold Coast

The Club experience adult ticket is valued at $120.00 (inc. gst) and children aged between 6-17 years of age at $30.00 (inc. gst). Benefits include:

4.9.1 Air-conditioned function room & direct access to premium reserved seating on level 3

4.9.2 Pre-game canapes & grazing buffet mid game

4.9.3 Private cash bars exclusive to Club guests for alcoholic & non-alcoholic beverage purchase

4.10 The Lounge, Metricon Stadium Gold Coast

The Lounge experience adult ticket is valued at $80.00 (inc. gst) and children aged between 6-17 years of age at $20.00 (inc. gst). Benefits include:

4.10.1 Access to excellent air-conditioned function

4.10.2 Premium reserved seating on Level 2

4.10.3 Private cash bars exclusive to Lounge guests for alcoholic & non-alcoholic beverage purchase

4.10.4 Gourmet food available for purchase

4.11 The Deck, Metricon Stadium Gold Coast

The Deck experience adult ticket is valued at $70.00 (inc. gst) and children aged between 6-17 years of age at $15.00 (inc. gst). Benefits include:

4.11.1 Premium seating on Level 3

4.11.2 Access to an exclusive private cash bar for alcoholic & non-alcoholic beverage purchases

4.11.3 Gourmet food available for purchase

4.12 The Rootop, Metricon Stadium Gold Coast

The Rooftop experience adult ticket is valued at $60.00 (inc. gst) and children aged between 6-17 years of age at $10.00 (inc. gst). Benefits include:

4.12.1 Premium seating on Level 4

4.12.2 Access to exclusive private cash bar for alcoholic & non-alcoholic beverage purchases

4.12.3 Food available for purchase

4.13 Food and alcohol package information:

Once payment confirmation the premium packages listed in 4.0 to 4.12 (inclusive) is paid to the Melbourne Stars, Ticketek or TixStar each client will receive a notification email within 10 days advising how to select your food and beverages and advise the Melbourne Stars of your dietary requirements. For any queries please direct them to VIP@melbournestars.com.au.

5. Corporate Facility

5.1.1 The Client is not permitted to make, or allow to be made, any alterations or additions to the Corporate Suite or the Dining Facility.

5.1.2 All crockery, cutlery, utensils, glassware, electrical equipment, fixtures and fittings in the Corporate Suite or Dining Facility remain the property of the MCG Caterer and must not be removed from the Corporate Suite or Dining Facility.

5.1.3 The Client must reimburse the MCC for all costs, expenses and liabilities arising from

any breakage or damage to the Corporate Suite or the Dining Facility and its contents caused by the Client or its guests; and

5.1.4 the replacement of any items taken from the Corporate Suite or the Dining Facility by the Client or its guests during the Client’s occupation of the Corporate Suite or Dining Facility.

5.1.5 The Client takes full responsibility for the behaviour of their invited guests whilst utilising the Corporate Suite or Dining Facility and must ensure that at all times, all of the Client’s guests behave in a proper manner, having consideration for other MCG patrons and their right to an uninterrupted viewing and enjoyment of the Event.

5.1.6 Riotous, disorderly, offensive or improper conduct or behaviour which is or may become noxious or offensive or may cause a nuisance, damage or disturbance to the MCC or any other person (as determined by the MCC) is prohibited in and about the MCG, including in a Corporate Suite or Dining Facility. The MCC reserves the right to remove from the MCG any Client or Client guests who breach this prohibition.

5.1.7 No alcohol or food is to be brought into any Corporate Suite or Dining Facility without prior permission in writing from the MCC, which may withhold permission at its absolute discretion.

6. RESPONSIBLE SERVING OF ALCOHOL

6.1 The MCG caterer adheres to the Responsible Service of Alcohol

6.2 Alcohol can only be consumed by patrons 18+ years of age

6.3 The Client accepts that at all times when access to the Corporate Suite or the Dining Facility is permitted, a member of staff from the MCG Caterer will be present to serve any alcohol. The Client must not, and must ensure that its guests do not, at any stage endeavour to provide, pour or refill any alcoholic beverage without the assistance of the MCG Caterer’s staff member.

6.4 If any person is in an intoxicated state, staff from the MCC and the MCG Caterer reserve the right to refuse the service of alcohol and require the person to leave the MCG.

6.5 Staff from the MCC and the MCG Caterer reserve the right to at any time close the bar in the Corporate Suite or Dining Facility where, in the opinion of those staff members, due to an excess consumption of alcohol by the Client, its guests or other people using the Corporate Suite or Dining Facility, there is a significant chance of unruly or threatening behaviour occurring.

5.0 CATERING

5.1 The Client accepts and acknowledges that the MCG Caterer will be the sole provider of catering services in the Corporate Suite or the Dining Facility.

6.0 ONSELLING & TRANSFERABILITY

6.1 The Client is not permitted to sell or on-sell any tickets to a Corporate Suite or Dining Facility.

6.2 Where the Client has breached the prohibition in clause;

6.2.1 the Melbourne Stars reserves the right to cancel existing or future reservations made by the Client without any refund of any amounts already paid for those reservations

6.2.2 The Client is liable at all times for all acts and omissions of all persons who use the Package reserved by the Client, including where the right to use the Package has been on-sold with the consent of the MCC.

7. TRANSFERABILITY

7.1 Melbourne Stars premium packages are transferable, provided they are transferred to individuals at the equivalent entry level or lower. For example:

7.1.1 Adult Lounge premium package tickets may be transferred to any individuals who is over 18+ years of age.

7.1.2 Children Lounge premium package tickets may be transferred to any other child who is aged between 6-17 years of age.

7.1.3 Only tickets within a specific premium package can be transferred into the exact premium package. No tickets are permitted to be used towards any other Melbourne Stars premium package. Refer 8. Payments/Cancellations/Refunds.

8. PAYMENTS / CANCELLATIONS / REFUNDS

8.1 Full payment for a premium package booking must be received by the Melbourne Stars online shop at the time of booking. If the relevant Event is less than 21 days from the booking date, full payment must be made at the time of the booking.

The Melbourne Stars reserves the right to resell a Premium Package if full payment is not made at the time of requesting a booking. No packages are held for individuals without full payment.

8.2 If a Client cancels a reservation, the Melbourne Stars will only refund any payment made on the following basis –

8.2.1 Time between date of cancellation and Event % Payment refunded 21 days or more 50% refunded

8.2.2 Less than 21 days No refund

8.2.3 If the Melbourne Stars is able to resell a Package cancelled by the Client in its entirety prior to the Event day, the Melbourne Stars will refund full payment to the Client subject to the Melbourne Stars retaining 25% of the total Package cost as a fee. The Client acknowledges that this fee is a genuine preestimate of any administration costs, bank transaction charges, catering and ticketing cancellation fees likely to be incurred by the Melbourne Stars as a result of the cancellation and this fee is not to be construed as a penalty.

8.2.4 Clients may be permitted to transfer their Package to another match day at the Melbourne Stars absolute discretion and subject to availability.

8.2.5 A 1.7% surcharge will apply to payment made using American Express or Diners cards.

9. CHILDREN POLICY

9.1 Persons aged between 0 – 17 years must be accompanied by a guardian over the age of 18+ years to be permitted into any of the Melbourne Stars Premium Experiences hosted at the Melbourne Cricket Ground, Victoria and Metricon Stadium, Gold Coast.

9.2 All children under the age of 6 years must always be accompanied by a parent or guardian.

9.3 All children under the age of 6 years can obtain free entry into all premium packages excluding The Ultimate and Stars Social.

10. DRESS CODE

All Clients and their guests are required to adhere to the dress code as notified from time to time by the MCC. Clients dining in any Dining Facility or Corporate Suite operated by the MCC on any event day will be required to comply with the dress standards as outlined on the MCC’s website and updated from time to time. The MCC reserves the right to refuse entry to persons who do not comply with the dress code.

11. MCC LIABILITY AND OTHER CLIENT OBLIGATIONS

11.1 The MCC does not accept any responsibility for –

(a) any losses as a direct result of the cancellation of, or changes to the Event or Package, or for the acts, omissions or errors of those over whom the MCC has direct control;

(b) damage to or loss of any property of Clients and their guests;

(c) death or injury to any person whatsoever;

(d) consequential loss or damage, except to the extent that the MCC has directly contributed to the loss, damage or injury. The Client releases the MCC from and against all claims, causes of action, suits or proceedings including claims for costs or expenses of any nature whatsoever and howsoever arising for any type of loss, damage or injury covered by this clause 10.1.

11.2 The Client indemnifies and agrees to keep the MCC indemnified against all actions, claims, demands, losses, damages, costs and expenses, made by any person whatsoever, for which the MCC is or may be or becomes liable in respect of or arising from:

(a) any default by the Client under this agreement;

(b) loss, damage or injury, including death, to property or persons, except to the extent that the MCC has directly contributed to the loss, damage or injury.

11.3 The Client must –

(a) abide by any other terms, conditions or requirements as imposed by the MCC from time to time; and

(b) not smoke in the MCG as it is a smoke free environment. Clients and their guests must obtain a pass out from selected exit gates and may only smoke outside the MCG.

12. PRIVACY AND TERMS OF USE OF MELBOURNE STARS WEBSITE

12.1 PRIVACY

Melbourne Stars, Cricket Australia and State or Territory cricket associations, including the Big Bash League teams (together, "Australian Cricket") collects your personal information to communicate with you in relation to information and offers from Australian Cricket and to provide Australian Cricket's products and services.

By providing your personal information you agree it will be disclosed to, and used by, Australian Cricket under the terms of this statement and Australian Cricket's Privacy Policy (at melbournestars.com.au/privacy), which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint.

Australian Cricket may disclose your personal information to other parties, including Australian Cricket's commercial partners and third party service providers, who may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. If you elect to receive offers and information, Australian Cricket may use and disclose your personal information to those third parties for direct marketing purposes.

You may choose not to provide the Melbourne Stars with certain information, though this may affect the service that you receive and may prevent Melbourne Stars from fulfilling your membership. As such, you accept any impact or loss of rights due to that choice.

12.2 OPTING OUT COMMUNICATIONS

Premium Experience customers may remove themselves from any mail, email or SMS communications at any time by following one of the following options:

• following the relevant unsubscribe instructions contained in any electronic communication which you receive from Melbourne Stars;

• writing to Melbourne Stars at PO BOX 327, East Melbourne VIC 8002 requesting cancellation of any email, SMS or mail communications; or

• emailing Melbourne Stars at VIP@melbournestars.com.au requesting cancellation of any email, SMS or mail communications; or

• contacting the Melbourne Stars contact centre on 1300MELBSTARS. Melbourne Stars may take up to 7 business days to process this request.

If you have previously unsubscribed from Melbourne Stars communications, you will be sent an email from Melbourne Stars with the option to resubscribe to Melbourne Stars communications.

12.3 WEBSITE TERMS OF USE

At any time, you enter Melbourne Stars web site you agree to be bound by the terms governing use of the web site that are in force at that time. To view the terms of use of the current Melbourne Stars web site, go to www.melbournestars.com.au.

13. ENTRY TO MATCHES & BEHAVIOUR

Entry to KFC BBL and rebel WBBL matches and continued attendance at those matches is governed by Cricket Australia’s Conditions of Ticket Purchase, Entry to a Venue and Attendance at a Match Policy, which can be found at melbournestars.com.au/terms-and-conditions as well as terms and conditions of ticket purchase of the relevant ticket agency and any terms and conditions of entry of the relevant venue owner, manager or hirer. Attendees must also abide by the ICC and Cricket Australia’s Policy Statement on Inappropriate Conduct, found at melbournestars.com.au/terms-and-conditions and any other terms and conditions of entry and attendance of the ICC and Cricket Australia. When entering and attending a KFC Big Bash match or Sheffield Shield match, you agree to abide by the conditions outlined in all the aforementioned policies, terms and conditions and policy statements and that you can be refused entry or removed from a venue due to failure to comply with any of these policies, terms and conditions and policy statements. You agree that Melbourne Stars can cancel your membership at any time if you fail to comply with any of these policies, terms and conditions and policy statements.

Offensive or aggressive behaviour is also not tolerated at any matches and may result the imposition of any penalties, including the cancellation of membership. This includes, but is not limited to, swearing, yelling, intimidation, aggressive, abusive or threatening behaviour towards players, staff, event staff, or other supporters and members, including, but not limited to, at matches, Melbourne Stars events, over the phone, on any social media, by email or in person.

14. CONCESSION POLICY

No concessions are available for Melbourne Stars Premium Experiences.

15. CHANGE OF PERSONAL DETAILS

The Client is responsible for notifying Melbourne Stars should their personal details change, including the withdrawal of concession status, contact details or any other relevant information that could affect the communication from the Melbourne Stars.

16. COMPANION CARDS

16.1 Companion Membership Application

Companion cards are permitted into Premium Experiences for BBL08. If the Companion is to attend a space, they will not have access to the hospitality packages (that includes food or beverage offers). Entry only includes access to the venue / room.

If a Companion is required for The Ultimate experience this person must be within the four guests in the group, not in addition.

17. AMENDMENT TO TERMS AND CONDITIONS

Melbourne Stars may vary these terms and conditions at any time in its discretion.

Melbourne Stars will give notice of any amendments to these terms and conditions by:

- email to the email address which you notified us of on the Registration Page or in any subsequent communication we receive from you updating your contact details; or

- posting the revised terms and conditions on www.melbournestars.com.au

18. INDEMNITY

To the full extent permitted by law, you indemnify and will keep indemnified Cricket Australia, State Associations, Melbourne Stars and their respective directors, officers, employees, agents and corporate partners from and against all costs, losses, damages or expenses arising out of or connected in any way from your registration of a Melbourne Stars Premium Experience.

To the full extent permitted by law, all warranties, conditions and representations about Melbourne Stars or the products and services advertised, offered to be provided or provided to Melbourne Stars, are excluded. If a term is implied by law into these terms and conditions and the law prohibits provisions in a contract excluding or modifying liability under that term, then it shall be included in these terms and conditions. However, liability for a breach of such term will be limited, at Melbourne Stars sole option, to one or more of the following:

• the replacement of the goods or the supply of equivalent goods;

• the repair of such goods;

• the payment of the cost of replacing the goods or acquiring equivalent goods; or

• payment of the cost of having the goods repaired,

or in relation to services:

• the supply of the services again; or

• the payment of the cost of having the services supplied again.

19. TECHNOLOGICAL ISSUES

Melbourne Stars is not responsible for any infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Melbourne Stars, including those that cause the delay or non-delivery of emails to and from Melbourne Stars. Melbourne Stars reserves the right to disqualify any individual who tampers with the registration process and to cancel a Melbourne Stars Premium Experience.

20. GENERAL

These terms and conditions are governed by the laws of Victoria. Each party submits to the non- exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning these terms and conditions.

No failure to exercise or delay in exercising any right, power or remedy by Melbourne Stars under these terms and conditions operates as a waiver of that right, power or remedy by Melbourne Stars.
